Check if it's lean. Ride at the slowest speed possible for at least 30 seconds then nail it. If it hesitates it's lean, if it takes off then stumbles it could be rich. Use the low speed needle before changing pop-off. Also, I used to run bottom and middle screws closed, top open 5/8 - 3/4.

I think it really depends on where you ride. On Cass lake in MI I would get stopped without cause and had to show extinguisher and USCG rating on my vest in the middle of the lake trying not to drown or sink my ski. (And I lived on the lake and got to know the A-holes by name). In Maryland...

I say keep the positive attitude, use this opportunity to upgrade. Your ski is too nice for that pipe, it's cancerous. Call Wamiltons and get this on the next truck out. It doesn't cost $500. It's price is $500, resale $400 so it's true cost is only $100. I use that logic on me all the time :)

It's missing the dimple by the stinger, so I don't believe it's an FX-1 chamber. Without a doubt you will need to cut and re-weld it to get it to fit and stay.
