Okay, I looked at relevant sections. The only two things remotely applicable would be negligent operation (and surf riding is not covered in any way there) and USCG regulated boating areas. Turns out the latter applies only to West Coast river bars - giving the USCG the authority to close bars and passages into the open ocean.
That's it.
Perhaps there are more state regulations such as what California has, but Oregon and Washington don't seem to have them.
In any event, this legality thing is a huge derail to the real issue: Don't be a dickhead with the surfers or anyone else on the water.
Nobody I ride with will put their ski in the water where surfers are even visible. It's that simple.
Surfers don't have motors and have to paddle into waves. It's a lot easier for me to pick and choose a wave or wave section. The spots we ride at are not desirable to surfers. We don't ride where surfers are.
