thanks.... I live is Daytona, no one cares about any silly laws like that :fingersx:
I appreciate the heads up though...

I cannot find it in the statutes, but I read in another forum that it is a freakin' thousand dollar fine. If that is true, I'd change the tag.

I'm gonna go search to see if this is actually the case. I can't believe it would be that much, but you never know.

316.2085(3) Motorcycle or moped license tag improperly affixed
This is classified as a moving violation.
First Offense: the violator must pay $1,000 plus any other costs assessed for a moving violation. Second Offense: the violator must pay a fine of $2,500, plus any other applicable costs assessed for a moving violation. The person’s driver license must be revoked for a period of one year.
Third Offense: the violator will be charged with a third degree felony, punishable as provided in ss. 775.082, 775.083, and 775.084, a mandatory fine of $5,000, and the driver license must be revoked for a period of ten years.

Florida's got some good laws too

Florida Department of Transportation and Respectable Dirtbiking said:
Section 7.0.1 any person riding a bike with more than 10" of suspension travel on a road should be killed. immediately.

Section 6.6.6 any person in possession of a motorcycle with more than 10" of suspension travel and a headlight shall be killed. immediately. twice.

Section 4.5.6 any person in possession of a motorcycle with more than 10" of suspension travel and a kickstand shall be killed. immediately. thrice.

wow... that actually makes me think twice.

The law was just passed in October, and I haven't heard of any instances around here where anybody has been charged. Other laws were passed with the same fines for first, second, and third offenses for doing wheelies and speeds in excess of 50 MPH over the posted limit.

I can't really understand the license plate fines being as high as they are, but I'd bet you'd have a fit if you had to pay a THOUSAND DOLLAR fine for the first offense. My chopper came with a vertical plate mounted to the back of the transmission housing and it got knocked off three times before I changed it to a fender mount. When I went to buy it was when I was first informed of the new law and the amount of the fine.

I have the notarized title from the dealer with his name and signature on it from date of purchase he also failed to pay any personal property tax on the bike so I am sure they will stick him with that.

I contacted the court house this morning and have the paper work on its way.

Yes he gave us a title but since he never licensed it in his name, he never paid taxes or personal property tax on it. So Mark had to pay all that at the DMV.

Even if we had called the guy he wouldn't have done nothing. He had the money he didn't want the hassle because he would have known he couldn't have sold it.

Thats already I am sure a judge will love to talk to someone who thinks it legit to never pay taxes on something.

you have him right there then.it was unlawfull for him to sell it to you without first transfering it to himself.the bill of sale that he gave you was bogus.the dmv should have caught that.you should have had a bill of sale from owner,not the purchaser.there is a legal term for what he did(cant think of it right now) but there are laws in place to prevent it from happening.you guys should not have paid the taxes without doing a little research first.


i would go back to the dmv and speak to a supervisor.you should not have even been able to register it.someone down there dropped the ball BIG TIME

he comitted fraud when he sold you a vehicle without a properly a properly assigned Certificate of Title.i cant believe the dmv didnt send you back to him right there.and then to send you a new title in his name! thats crazy!does that mean i could go down there and put my truck in your name as long as i pay tax?!someone down there is not doing their job.
 
Nick, just an FYI for you: Florida passed a law making vertically-mounted license plates illegal. I had to change mine on my chopper because of this.
